| When
most medical malpractice lawsuits are settled, a gag clause is signed as
part of the settlement contract. In the case of Richard
"Zig" Zickefoose vs. TLC, TLC's attorneys failed to put a
gag clause in the contract. After TLC executives discovered that
the settlement agreement contained no gag clause, TLC's attorneys
unsuccessfully attempted to renege on the settlement.
Since Zig acquired internet domain names based on executives'
personal names in addition to tlcbigskylasercenter.com
several years ago, TLC should have suspected that Richard was planning
to launch these web sites following the conclusion of his lawsuit. For anyone who doesn't know, Elias Vamvakas is TLC's Chairman of the Board, and Stephen Kilmer is the company spokesman. Dr. Boes is the TLC surgeon who operated on Zig, and Dr. Jones is the optometrist who received a huge referral for in exchange for talking Zig into having lasik with Dr. Boes. Zig had to get a court order to force TLC to pay the agreed-upon amount, which he has never revealed. In TLC's Response To Plaintiffs' Motion For Order Compelling Performance Of Settlement And For Sanctions, TLC claimed that There still needs to be negotiation about the scope of the confidentiality provision in the release, and that these negotiations still need to occur.
The judge rejected TLC's arguments and forced TLC fulfill their contract, which contained no gag clause. After TLC complied with the judge's order, Zig contacted TLC and offered to continue negotiations about the scope of the confidentiality provision, as had been previously demanded by TLC. TLC responded by sending a letter to Zig in which they threatened to file a lawsuit against him for violating a gag clause that doesn't exist. They also falsely claimed that he had attempted to perform extortion by demanding money in exchange for not providing turning an incriminating tape over to Fox News. ** Listen to the tape ** Well, they did get one thing right in the letter, and that was that Zig was planning to have an interview with Fox News in Chicago, and here are pictures from the trip. |
